WHY DO YOU NEED A PRIVACY POLICY?

South Africa’s Protection of Personal Information Act (POPIA) has commenced on 1 July 2020. All businesses must comply with the Act by 1 July 2021. You have one year to get ready! Start the process sooner rather than later. Individuals’ right to privacy is a constitutional right and needs to be respected regardless of the POPI Act. The purpose of the Act is to ensure that you collect, process, store and share individuals and businesses’ personal information in a responsible way. And when you don’t, you will be held accountable.

The General Data Protection Regulation (GDPR) sets the rules for the collection and processing of personal information of individuals within the European Union (EU). If you offer goods or services to EU-based individuals or you monitor the behaviour of EU-based individuals and their behaviour takes place within the union, the GDPR applies to your business.

WHY DO YOU NEED A FREEDOM OF EXPRESSION POLICY?

 

If users can create content or express themselves (publicly or privately) on your website, a Freedom of Expression policy informs them what is acceptable content and what content may be removed.    

WHY DO YOU NEED TERMS AND CONDITIONS?

If you have an online shop, Terms and Conditions details how you deliver your goods or services. When a complaint arises, it serves as a legally binding document. You can also clarify anything that is unclear.
